Public Law
Our work in public law has resulted in a depth of knowledge and expertise regarding the tort claim requirements under the California Tort Claims Act and the immunities and privileges afforded to public entities and their employees under the Government Code. We also have an expertise in litigation of cases under the Welfare and Institutions Code and the Education Code.
Our representation of public entities in litigation requires a thorough knowledge of Civil Service rules, County and City Charters, Memoranda of Understanding, departmental rules, regulations, and policies, collective bargaining agreements, and state rules and regulations, when they have bearing on the representation of our clients.
Kessel & Megrabyan has over 20 years of experience working with public entity clients. We understand the fiscal and social accountability of our clients to the taxpaying public; we understand that cases we work on may result in media focus; and, we understand that complex litigation strategies must be juggled within budgetary constraints. We apply cost-benefit and risk-benefit analyses to our recommendations, and maintain open and clear communications with our clients about liability exposures.
Our overriding objective in all cases, in which we defend a public client, is to provide a defense that is appropriate, taking into consideration the complexity of the legal and factual issues, and the potential exposure that the case presents to our client.
